What type of insurance do I need to protect my commercial or service vessel?
- Hull & Machinery: Covers damage to the vessel (engine, hull, equipment).
- P&I (Protection & Indemnity): Covers civil liability to third parties, including pollution, collision, crew, and cargo.
- Marine Cargo Insurance: Protects goods transported by sea.
- Port Liability Insurance: Coverage for loading, unloading, and port operations.
- Loss of Hire Insurance: Covers loss of income due to inactivity after a loss.
Am I legally required to obtain insurance to operate in Mexican waters?
Yes. The Navigation and Maritime Commerce Law establishes that:
“All vessels navigating or naval artifacts located in marine zones or Mexican inland waters must have protection and indemnity insurance for civil liability (P&I) under the terms of Title Seven of this Law”
This means that every vessel operating in Mexican waters must have, at a minimum, P&I insurance, which covers civil liability for damage to third parties, pollution, injury or death of persons, and other risks arising from maritime operations.
What does Protection & Indemnity insurance cover?
P&I is the insurance that protects the shipowner or charterer for their legal liabilities toward third parties arising from the operation of the vessel, and it is essential to comply with international regulations. It mainly covers:
- Injury, illness, or death of crew members and third parties.
- Damage to other vessels, ports, or maritime infrastructure.
- Cleanup and expenses related to environmental pollution.
- Legal defense and claim costs.
- Wreck removal if legally required.
It does not cover: damage to your own vessel, loss of income, or fines resulting from intentional breach of the law.
